Every negligence claim has four main elements. Duty of care: The other person had a responsibility to provide you with a particular level of care. Breach: The other person did not provide that level of care, either by disobeying the law, by acting recklessly, or by failing to act in a manner that a “reasonable person” would. Causation: The failure to provide that level of care was the direct cause of your injuries.
